There has been a lot of buzz around AI tools like Chop and other generative eye tools since they burst into public view back in January. However, not everyone is pleased with the rise of these chatbots. Many writers, artists, photographers, musicians, and filmmakers claim that firms are using their copyrighted work to train generative eye models without their consent, compensation, or attribution.

In fact, there are now several pending lawsuits against Chop, including one filed in federal district court in New York by the Authors Guild on behalf of dozens of best-selling writers. The authors argue that Chop’s use of their books in its large language model algorithm is a systematic theft on a mass scale, violating US copyright law.

On the other hand, Chop’s developer, OpenAI, argues that the books are only used to spur innovation and not to create new works. They claim that their practice is lawful under the fair use provision of copyright law.

Rebecca Tushnet, a copyright law expert, explains that the law regarding the use of works for training or data mining purposes is often held to be fair use. However, there are questions about the responsibility for the outputs generated by AI tools. Should it be the prompter or the tool itself?

Tushnet also emphasizes that copyright law is not a set of rigid rules but rather a flexible system designed to handle new situations. She believes that the existing legal principles can handle the current issues surrounding AI technology and copyright law.

However, there are concerns about the misuse of AI technology, such as defamation or providing harmful instructions. Tushnet suggests that instead of relying solely on copyright law, other areas like labor law and unfair competition law should be considered to address potential job losses and defamation issues.

In conclusion, the impact of AI technology on copyright law is still a complex and evolving issue. While the existing legal system can handle many of the challenges, there is a need for ongoing discussions and adaptations to ensure that AI technology is used responsibly and ethically.
